Overview

tartantouch.co.uk is the website of The Fountain Scotland Ltd, a Scottish company with its main commercial premises at Elphinstone Road, Port Elphinstone, Inverurie, Aberdeenshire, AB51 3UR, registered no. SC241820 (hereinafter referred to as “The Fountain”). The following terms and conditions govern your use of The Fountain services and tartantouch.co.uk website and will apply between you and The Fountain whenever you buy online.

Please note, we reserve the right to change these terms and conditions at any time, and it is up to you to check regularly prior to ordering in case there are any changes. These terms and conditions do not affect your statutory rights.

Terms of Service

When you place an order via the website we will treat that action as an offer to buy. Once the order is placed you will receive confirmation in the form of an email and at this time we enter into a contract with you.

This confirmation email will be sent to the email address given in the order form and will detail the products ordered, payment method, total cost (including VAT and P&P) and usual delivery times.

You must check that all details on this confirmation email are correct and contact us as soon as possible in the event that any of the details are incorrect.

 

Product Specifications and Suitability

Published product details are the best available at the time. The Fountain shall not be held responsible for the accuracy of any advice given regarding the suitability (or otherwise) of any products. If you have ordered an item that has an unsuitable product description we will remedy this by providing you a full refund upon the return of the item. Please see our Returns section for details: Delivery, Exchanges & Returns.

 

Availability / Estimated Delivery Times

Availability information for our products is listed on each individual product description. If The Fountain does not have enough stock to deliver the goods you have ordered, we will not charge your credit or debit card until the items are back in stock and ready for dispatch.

We do our best to ensure availability of all advertised products and endeavour to despatch all such products within the quoted time. If there is a delay we will inform you of this via email and the product(s) will be despatched as soon as it is available. If you have ordered multiple items they may arrive separately.

The Fountain has no liability to you for any delay in the delivery of products ordered. We will do our best to get all orders sent out as quickly as possible. You have the right to cancel delayed orders at any time, just contact info@tartantouch.co.uk with your order number.

Occasionally we find ourselves having to withdraw a product because it has been discontinued. If you have placed an order for a product that has been discontinued we will inform you as soon as possible and offer you an alternative if one is available.

Payment

Payment over the Internet can be made via our secure check out pages using Visa, Mastercard, Switch/Maestro, Cirrus, American Express, Discover or PayPal. Card charges will appear on your statement as "The Fountain (Scotland) Ltd"

All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

All prices are correct at the time of writing and quoted in pounds sterling (£). The prices include Value Added Tax (VAT) at UK rates if relevant. It may be necessary to adjust prices in the event of an increase in VAT rates, or as a result of a manufacturer price increase. Customers are entitled to a full refund if this is not acceptable.

Due to the nature of the clearing system your credit card payment will be taken at the point of processing. If a problem in supply should occur, your payment method will be refunded as swiftly as possible.  The refund may take a couple of days to show as cleared funds on your account, depending on payment provider.

If your delivery address is outside of the UK, you may be required to pay import duties and taxes when your order reaches your country. These and any additional charges for customs clearance are your responsibility. Discount vouchers and codes cannot be used in conjunction with any other offer, or on sale products.

 

Governing Law

These terms and conditions shall be governed by and construed in accordance with Scottish Law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Scottish courts.

 

Delivery

UK orders will be delivered using Royal Mail.

International order will be despatched via Royal Mail or Parcel Force.

Returns / Cancellations and Exchanges

Orders may be cancelled at any time before they are despatched, simply contact us for a full refund. If the item has already been despatched then please see our returns policy.

You have the right return your item within 30 days from the date of dispatch. Please contact us to discuss your intention to return your item(s).

We will be happy to exchange any item which has been delivered to you and is found to be damaged, faulty or shipped incorrectly through any circumstances which are our own error. Please ensure that you contact us as soon as you receive an item which is damaged or faulty in order for the exchange or refund to be processed. In any event this must take place within 30 days from the date of dispatch of the order.

Liability

We shall not be liable for incidental or consequential damages or expenses. This includes, but is not limited to, damage to property, lost income, profits, economic or commercial losses and third parties claims.

We will do our best to get all orders despatched as quickly as possible. We have no liability to you for any delay in the delivery of products ordered. You have the right to cancel delayed orders at any time and get a refund prior to the item being despatched.

This warranty does not affect your statutory rights.

Ethical Sourcing Policy

As a reputable and trusted business committed to offering its customers high quality products, The Fountain recognises its obligation to ensure that suppliers are operating ethically.

We expect our suppliers to consistently provide an environment which protects their employee’s health and safety and basic human rights.

All suppliers are expected to comply with their national employment laws and regulations with particular regard to:

  • Minimum age of employment
  • Freely chosen employment
  • Health and Safety Freedom of association and the right to collective bargaining
  • No discrimation
  • No harsh or inhumane treatment
  • Working hours
  • Rates of pay
  • Terms of employment.

The Fountain will never knowingly source stock from countries which are in breach of the above principles. We look to our suppliers to instil these principles when dealing with their own supply chain.

Because of the sometimes complex nature of our supply chain, it is not always possible to monitor and control the conditions of each individual involved in the production of our products. However, as The Fountain and tartantouch.co.uk continues to grow it recognises the importance of being productive and doing everything within its power to support the rights of those involved in the manufacture of its products.
